SB1526: Why This Bill Needs to be Amended or Stopped

  • Would label existing structures that are not at the new construction level required by FEMA as ‘nonconforming’ and unsafe – even if they are historic landmarks!
  • Would allow for demolition permits to be issued without a public hearing for any structures on the coastal control line that are not new construction; does not protect historic structures which have exemptions from the flood requirements
  • Requires maximum redevelopment of any site that previously had a historic landmark. Example, if the maximum zoning is 20 stories, a 3-story historic building could be replaced with a 20 story tower. The demolition would no longer have to be reviewed at a public hearing
  • Strips power from cities to enforce rules for proper building maintenance, such as demolition by neglect provisions of local cities and downs.

 

According to news reports, this bill is being pushed by a lobbyist group connected to “Resilient Future Florida,” a ‘non-profit’ whose contributors are not known and one that is donating to elected officials – not cool!

Amendment Needed

We believe the below amendment to the bill will ensure historic districts and buildings remain protected except in cases of demolition ordered for safety reasons.
